Saunatic terms of service

Draft. This text takes effect when Saunatic launches; parts marked like this are still being completed.

These terms are the agreement between you and Lovely Print Sweden AB, organisation number 559246-6147, Gullbergsvägen 37 A, 511 58 Kinna, Sweden ("we"), about the Saunatic app and saunatic.app. You accept them when you create your account. Saunatic is free: it is paid for by the ads shown in it, and it uses your personal data as the privacy policy describes. You always keep the rights that the consumer law of the country you live in gives you; nothing in these terms takes them away.

1. Who may use Saunatic

You must be 18 or older, and you confirm that you are when you create your account. If we learn that someone is younger we close the account and delete what it holds. One account per person. Keep your password to yourself and tell us as soon as you think someone else has used your account. We hold you responsible for what is done through your account only when you did it, allowed it, or were careless with your sign-in.

Do not: use someone else's account or create accounts automatically; try to get around limits, blocks or security; upload malware; use the app to advertise or to contact people who have not asked for it; pretend to be someone else, another organisation or Saunatic.

2. What Saunatic is

Saunatic is a shared catalog of public saunas, a personal sauna log and a feed of sauna pictures. The catalog is made by its users and from open sources (OpenStreetMap, Wikidata, Wikimedia Commons, and facts from operators' and municipalities' own websites); entries marked "Unconfirmed" have not been checked by anyone. Opening hours, prices and even whether a sauna still exists can be wrong or out of date - check with the operator before you travel. We do not run any sauna: a visit is between you and the operator, on the operator's terms, and sauna bathing is your own decision about your health. Saunatic is not a medical product and gives no health advice.

The app needs Android 8.0 or later and an internet connection; the log also works offline.

Ads. Saunatic is paid for by advertising. Ads appear in the sauna list and in the feed, between content, and are always marked "Ad" - never in your log, your saved collections, forms or the map. They are delivered by Google AdMob; the advertiser, not we, is responsible for an ad's content, and the ad's information icon shows who the advertiser is and why you see it. Your choices about personalised ads are under Account → Ad choices. Users' posts are not ads, and nobody can pay for a position in the feed or the catalog.

How the feed and the lists are ordered. The "For you" tab shows pictures from people and tags you follow and interests you chose first, then more-liked pictures, then newer ones. "Following" shows only accounts you follow, newest first; "New" and "Popular" are what they say. We build no profile of you beyond what you choose yourself. The sauna list is ordered by distance from you or the place you searched.

3. Your content

You own what you upload. To run Saunatic we need your permission to use it, so you give us a licence that is non-exclusive, free of charge and valid worldwide, to: store and copy your content; make technical versions of it (other sizes and formats, a cropped preview); show it with your display name to other people in the app and on saunatic.app; and let others save it in their collections and share a link to it. We may let the companies that work for us (the automatic picture check, hosting) do these things on our behalf, and nobody else. We do not sell your content, we do not use it in advertising, and if we would like to show a picture of yours anywhere else we ask you first. The licence for a piece of content ends when you delete it or your account. The only exceptions are in section 9.

You promise that the content is yours or that you have the right to share it this way, that every recognisable person in a picture has agreed to be shown in Saunatic, and that it follows the content rules.

A sauna you add becomes part of the shared catalog, which other users and the sauna's operator can correct and add to. For the facts and the description in a sauna entry, the licence above does not end when you leave (section 9).

Reviews and comments. Write reviews only about saunas you have visited yourself, and about the place - not about named staff or guests. Do not review a sauna you run or work for, and never write or order a review for payment or a benefit. We do not check that reviewers have visited; we remove reviews that are reported and break these rules.

4. The content rules

The Content rules in the app (Account → Content rules) and at saunatic.app/rules, with the date of the current version, are part of these terms. You accept them when you create your account, and again if they change. In short, you may not post:

To keep the service usable for everyone there are daily limits on how much one account can add (for example 30 pictures, 60 comments, 10 saunas and 10 reports per 24 hours). The app tells you when you reach one.

5. How content is checked and what we may do

Automatic check. Every picture is analysed by an automated image-recognition service (Sightengine) before anyone else can see it. It estimates how likely the picture is to contain nudity or sexual content. A clear pass is published at once. A clear fail is rejected automatically, without a person looking; you see that on the picture. Anything in between waits until a person on our team has looked. Text (comments, reviews, sauna details) is not checked automatically.

People. Reports from users and notices from anyone else are read by a person on our team, who decides. We also look at content on our own initiative.

What we may do. Depending on how serious it is, we may: decline or remove a picture; delete a comment or review; hide a sauna entry from the catalog; remove a verified-owner mark; suspend an account (it can still read and use its log, but not post) for a stated period or until further notice; or close an account. For ordinary rule-breaking we warn first and suspend on repetition. For the most serious content - sexual content involving minors, threats, pictures of people taken in secret - we act at once and without warning. We choose the mildest measure that solves the problem, and we weigh your freedom of expression against other people's rights.

You are told why. When we restrict your content or your account we tell you, in the app or by email, what we did, which rule or law it is based on, the facts we relied on, whether it started with a report or with our own check, whether an automated tool was involved, and how you can contest it. We keep a record of the decision for 24 months.

6. Reporting content

Every picture, comment, review and sauna has a Report action. If you do not use the app, write to report@saunatic.app or use saunatic.app/report. If you believe something is illegal, please tell us (1) why you think so, (2) exactly where it is - the link, or the sauna's or picture's name and the user who posted it, (3) your name and email address, and (4) that you believe in good faith that what you tell us is accurate and complete. You do not need to give your name when reporting sexual content involving minors.

We confirm that we have received your report, a person decides without undue delay, and we tell you what we decided and how you can contest it . We do not reveal who reported to the person reported, unless the law requires it.

If someone's life or safety is at risk, call 112 first.

If something in Saunatic is yours or about you. Rights holders: if you believe a picture or text infringes your copyright, write to report@saunatic.app with your name and contact details, where the content is, what your right is and why the use is not allowed, and a statement that the information is correct. We act quickly - normally within 3 working days - and tell both you and the uploader what we decided and why. People in pictures: if you can be recognised in a picture and have not agreed to it, tell us where it is; we take it down without asking for reasons. Sauna operators: if you run a sauna that is listed, you can correct it yourself as a verified owner (section 8), or write to us to have facts corrected, to have the entry marked as not open to the public, or - if the sauna is not a public one - to have it removed. We do this free of charge and normally within 7 days. We close the accounts of people who infringe repeatedly.

7. If you disagree with a decision

Whether we acted against your content or account, or decided not to act on your report, you can ask us to look again, free of charge, within six months: write to support@saunatic.app and tell us which decision and why you think it is wrong. A person - never only an automated tool - reviews it, and we answer with reasons, normally within 14 days. If we were wrong we reverse the decision without delay.

You can also complain to the Swedish Post and Telecom Authority (PTS, pts.se), which supervises the EU Digital Services Act in Sweden, or to the coordinator in your own EU country, and you can always go to court. For disputes about the agreement itself, see section 12.

8. Claiming a sauna

If you run a sauna you can claim it. When you do, you act for its operator, and you confirm that you may. We review claims by hand and may ask for proof. A verified owner can edit the listing, is shown as its owner, cannot review the sauna and must not arrange reviews of it. We can take a verification back if it was wrong or is misused, and we tell you why.

9. Leaving, and what happens to your content

You can leave at any time, without giving a reason: Account → Delete account in the app, or saunatic.app/delete-account.

Right of withdrawal. For 14 days after you created your account you also have a statutory right to withdraw from this agreement. It costs nothing and you need no reason: use "Withdraw from the agreement" under Account in the app or at saunatic.app/withdraw, or tell us in any clear way, for example by email or with the form at the end of these terms. We confirm by email when we received it. The result is the same as deleting the account.

What is deleted: your log, your private saunas, your pictures and feed posts, likes, follows and saved collections - from the live service within minutes.

What stays, so that the app keeps what people contributed: public sauna entries you added (facts and description), your reviews and your comments - all of them without your name, shown as coming from a removed account. If you would rather have your reviews and comments deleted too, tick that box when you delete the account, or write to us afterwards - we delete them, no questions asked. Before you leave you can ask us for a copy of your content in a common, machine-readable format.

We can end the agreement if you seriously or repeatedly break these terms; we tell you why and, unless the breach is serious enough to need an immediate stop, we give you 14 days' notice so you can save your content. If we ever close Saunatic altogether we tell you at least 60 days ahead. If Saunatic is taken over by another company we tell you at least 30 days ahead; you can delete your account before the transfer, and the new company must respect these terms.

10. What you can expect from us

We keep Saunatic working, secure and up to date for as long as you have an account, and we fix faults you tell us about within a reasonable time. Install the app updates we publish - a fault that comes from a missing update is not ours to answer for. The service can be down for short periods for maintenance or because of things outside our control.

What we are not. We do not run the saunas, and we cannot check every entry, review or picture that users and open sources provide. Those are the responsibility of whoever wrote them; we remove what breaks these terms when we learn of it.

If something goes wrong with the service itself you have the rights the consumer law gives you, including to have the fault fixed, to end the agreement and to compensation for loss we have caused. Nothing in these terms limits those rights or our liability under the law.

11. Changes

Changes to the app. We may change Saunatic's functions for these reasons: to fix faults and keep it secure; to follow the law or a decision by an authority; to adapt to new versions of Android, the app stores or the services we depend on; to add or improve functions; to stop abuse; or to remove a function that few people use or that we can no longer run at reasonable cost. Changes never cost you anything. If a change makes the service noticeably worse for you, we tell you by email at least 30 days ahead what changes and when, and you can end the agreement free of charge up to 30 days after the change.

Changes to these terms. We may change the terms for the same reasons, or when the app gains a function the terms do not cover. We tell you in the app and by email at least 30 days before a change that matters applies, with a summary of what is new. If you do not want the new terms you can delete your account before they apply; if you keep using Saunatic after that date, the new terms apply. A change that would make you pay, or that lets us use your content or data in a new way, only applies if you actively say yes. Earlier versions stay available at saunatic.app/terms.

12. Law and disputes

Swedish law applies to this agreement. If you live in another EU or EEA country you also keep the protection of the mandatory consumer rules of that country. Tell us first - support@saunatic.app - and we will try to put it right. If we cannot agree you can turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, www.arn.se; we take part in its procedure and follow its recommendations. If you live elsewhere in the EU, the European Consumer Centre in your country (eccnet.eu) can point you to the right body there. You can always go to court where you live or in Sweden; we can only take a consumer to court where the consumer lives.

If a part of these terms turns out to be invalid, the rest still applies, and the invalid part is replaced by what the law says.

13. Where the catalog comes from

Part of the sauna catalog comes from OpenStreetMap - © OpenStreetMap contributors, available under the Open Database Licence (ODbL), openstreetmap.org/copyright. Entries from that source are marked, and we keep them as a separate dataset; corrections we and our users make to those entries are available under the same licence - ask at support@saunatic.app. Some entries come from Wikidata (CC0). Pictures from Wikimedia Commons show their author and licence and remain under that licence (for example CC BY-SA 4.0): you may reuse them on its terms; we show them resized and sometimes cropped. Facts such as opening hours and prices may come from the operator's own website, with the source shown.

Everything else in the app - the design, the software, the Saunatic name and the catalog as a whole - is ours or our users'. You may use the app for your own, private purposes; you may not copy the catalog in bulk or collect it automatically, except the parts that are under an open licence, on that licence's terms.

14. Language and versions

These terms exist in English. Swedish, Finnish and German versions follow before the app is marketed in those languages. Saunatic is offered in the EEA, Switzerland and the United Kingdom. You can rely on the version in the language you used when you created your account. The current and earlier versions, with dates, are at saunatic.app/terms, where they can be saved or printed.
